Mileage Reimbursement and Per Diem Allowance for Travel

Nevada workers compensation guidelines allow for reimbursement of transportation costs including mileage and per diem travel expenses associated with approved medical care and treatments, vocational rehabilitation re-training programs, and eligible designated hearings. Many injured workers are unaware of these benefits, although they are listed in the explanation of benefits form that is provided when a claim is accepted. However, there are certain guidelines, requirements, and time limitations that must be followed in order to receive such reimbursement.

Mileage Reimbursement for Transportation Expenses

Under Nevada workers compensation guidelines, injured workers can receive monetary compensation for the miles traveled to and from approved appointments, such as for health care, vocational rehabilitation, and eligible designated hearings. The guidelines for miles traveled are a little bit different for each type of approved travel. However, the monetary compensation is the same for all approved appointments pursuant to NRS 616C.150. As of January 1, 2013, injured workers are eligible to be reimbursed 56.6 cents per mile traveled for all eligible appointments.

Health care appointments – An injured worker may receive compensation for miles traveled to and from health care appointments and treatments related to their injury or illness if the place of the appointment is 20 miles or more away from the injured worker’s home. If the worker is still employed during treatment, this mileage will be calculated from the worker’s place of employment if the medical care appointment is made during work hours. Additionally, workers who must travel 40 miles or more during a week for medical care are also eligible for compensation.

Vocational rehabilitation – In addition to medical care, miles can be counted for transportation to and from an approved vocational re-training program that is associated with the worker’s injury or illness if the miles traveled to such a program exceed 50 miles per day.

Designated hearings – Workers are entitled to compensation to eligible designated hearings if the worker must travel 20 miles or more one way from the worker’s home or place of employment. An eligible hearing is an appeal that is initiated by the employer or the insurer regarding a decision that favored the injured worker and is upheld by the hearing officer at the appeal.

Reimbursement for Meals

If eligible appointments require the injured worker to travel during certain times of the day, the worker can be reimbursed for meals as well as for miles traveled. If the worker must be on the road before 7 a.m., between the hours of 11:30 a.m. and 1:30 p.m., or cannot make it back home or to work until after 7 p.m., the worker is eligible to be reimbursed for meals. If travel due to eligible appointments results in the employee being on the road for a combination of these times, meals for each time period are eligible for reimbursement.

Reimbursement for Lodging

In some cases, the injured worker may be reimbursed for lodging to stay away from home or work overnight for an eligible appointment. The place of the appointment must be 50 miles or more one way from the worker’s home or place of employment. In addition, the worker must be required, as a part of the appointment, to remain away from home or work for the night in order to be eligible for compensation.

Filing Requirements for Reimbursements

In order for an injured worker to be reimbursed for eligible expenses involving miles traveled and per diem expenses such as meals and lodging, the employee must file a form entitled “Application for Reimbursement of Claim Related to Travel Expenses”. This form must be filed with the insurer no later than 60 days after the expenses were incurred. One form should be completed for each week of expenses. The worker will not receive any reminders to complete these forms. When workers wait to submit these forms until the end of the claim, they will only be reimbursed for the previous 60 days of qualifying expenses. To be on the safe side, workers should fill out the forms each week as expenses occur, then send in the completed forms every month.
